1 Agreement

This Agreement specifies the Terms and Conditions for access to and use of CISSP Cyber Training courses, coaching programs, services, and all other products. It may be modified at any time by Shon Gerber or authorized representatives, with modifications effective immediately. The current version is always available at cisspcybertraining.com/terms. Each use of the site, email opt-in, or purchase constitutes your unconditional acceptance of this Agreement.

2 Intellectual Property

(a) Our Content

All content on this site is and shall remain the property of Shon Gerber or its content suppliers, protected under applicable copyright, patent, trademark, and other proprietary rights. Copying, redistribution, or use of any content without express written permission is prohibited. You will not acquire any ownership rights through your use of this site. CISSP Cyber Training is a trademark of Shon Gerber.

(b) User-Supplied Content

By posting in any community, forum, bulletin board, chat room, or other interactive area, you grant CISSP Cyber Training a perpetual, irrevocable, royalty-free license to use, publish, distribute, create derivative works from, display, and perform such materials in any form or media. You also grant other users a perpetual, royalty-free license to view, download, and reproduce your postings for personal use only.

(c) Personal Use License

Shon Gerber grants you a limited, revocable, non-exclusive license to use this site solely for your own personal use. You may not republish, distribute, sublicense, sell, or create derivative works from site content. Use is at the sole discretion of Shon Gerber, who may terminate your access at any time.

(d) Prohibited Uses

All other use of content — including uploading, downloading, modification, publication, transmission, transfer, sale, reproduction, or republication — is strictly prohibited without prior express written consent from Shon Gerber.

3 Refund & Guarantee Policy

(b) After 30 Days — All Sales Final

After the 30-day guarantee period, all sales are final. No refunds, partial refunds, or credits will be issued for any reason, including but not limited to:

• Monthly or annual membership fees already billed
• Partial-period cancellations
• One-time course or coaching purchases
• Trial promotions that convert to paid subscriptions
• Bootcamp or live event program fees

It is your sole responsibility to cancel before your next billing date if you do not wish to be charged. Cancellations cover future payments only; past payments are not eligible for refund after the 30-day window.

(c) Subscriptions and Memberships

CISSP Cyber Training memberships are recurring subscriptions billed on the schedule selected at purchase (monthly, quarterly, or annually). Trials automatically renew at the stated rate unless cancelled. All cancellation requests must be submitted via the Cancellation Form at cisspcybertraining.com at least 48 hours before your next billing date. Cancellations are effective immediately upon processing.

(d) Holiday Cancellation Window

For cancellations near major US holidays, the 48-hour window is extended to 3–5 days prior. This includes Christmas Eve, Christmas Day, New Year's Eve, New Year's Day, Thanksgiving (and the day before and weekend after), and all US federal bank holidays.

(e) Conditional Promotional Guarantees

SELECT promotions may include a conditional guarantee beyond the standard 30-day period. Such guarantees are subject to conditions posted on the promotion page at the time of purchase, which may include proof of engagement with training materials and community participation. We do not offer unconditional guarantees beyond the standard 30-day policy.

4 Cancellation Policy

To cancel your membership or subscription:

• Submit the Cancellation Form at cisspcybertraining.com at least 48 hours before your next billing date (or 3–5 days before major US holidays).
• Cancellations submitted within the refund window (30 days of original purchase) are eligible for a full refund per Section 3.
• Cancellations submitted after the 30-day window take effect at the end of the current billing period. No refunds are issued for the current period.
• If you cancel and later re-subscribe, you will be reinstated at the current rate, not your original rate.

5 Digital Product Shelf Life

Non-subscription digital products (courses, downloads, one-time purchases) remain accessible for up to 12 months from the date of purchase. This shelf-life provision does not apply to active recurring memberships, which remain accessible as long as membership dues are current.

Old or discontinued content may be removed from membership areas at any time, including from lifetime membership areas. Lifetime membership covers courses and recordings available at the time of purchase only and does not include future content, live events, private coaching, masterminds, or community access unless specifically stated. Lifetime access is tied to the life of the product and business — should CISSP Cyber Training cease operations, no refunds or continued access are guaranteed.

6 Video & Audio Content

(a) Informational Purposes Only

All recordings on this site are provided for informational and entertainment purposes only. They do not constitute legal, financial, tax, medical, or other professional advice and should not be relied upon as such.

(b) Third-Party Hosted Recordings

Some recordings may be hosted on third-party platforms such as YouTube. CISSP Cyber Training claims no intellectual property rights over third-party platforms and embeds content pursuant to applicable licenses. Such embedding does not create a partnership or agency relationship with those platforms.

(c) Recordings Owned by CISSP Cyber Training

Recordings created by Shon Gerber / CISSP Cyber Training and hosted on our servers or third-party cloud services remain the exclusive intellectual property of CISSP Cyber Training.

(d) Personal Use License

When you view or listen to recordings on this site, you do so under a personal, non-exclusive, revocable, non-transferable license. You may not resell, redistribute, reproduce, or summarize recordings. Any recordings cached locally should be deleted within 24 hours of viewing.

7 Disclaimers

Earnings Disclaimer

Content on this site is for educational and informational purposes only. CISSP Cyber Training makes no representations or guarantees regarding income, earnings, or results. Any income figures mentioned are anecdotal. Success depends on individual factors including skill, experience, dedication, and market conditions. Past results are not indicative of future performance. You are solely responsible for your own results.

8 Coaching Programs

(a) Training and Materials

All training materials — including handouts, presentations, audio/video content, software, and data — are the sole and exclusive property of CISSP Cyber Training. You are granted a limited, revocable, non-exclusive license to access and use these materials for personal educational purposes only. You may not distribute, publish, display, or create derivative works from training materials.

(b) Student Conduct

You agree to: (1) not disrupt the training or venue; (2) not record any portion of live training by any means without permission; (3) keep personal belongings with you at all times; (4) use materials for personal educational use only.

(c) Safety and Security

CISSP Cyber Training reserves the right to ask any participant to leave an online or in-person training if their conduct poses a safety or security concern. Participants removed for behavioral reasons are not entitled to a refund.

(d) Recordings and Likeness

By participating in training, you grant CISSP Cyber Training and its affiliates an irrevocable, non-exclusive, perpetual, royalty-free right to record, photograph, and use your voice and image for any business purpose. You waive any moral rights in such recordings to the maximum extent permitted by law.

(e) Release of Liability

To the maximum extent permitted by law, you release Shon Gerber, CISSP Cyber Training, its affiliates, officers, employees, contractors, and agents from any and all claims arising from participation in training or use of training materials.

(f) Indemnification

You agree to indemnify, defend, and hold harmless Shon Gerber and CISSP Cyber Training from any claims, damages, costs, and expenses (including attorney's fees) arising from: (1) your violation of this Agreement; (2) your violation of applicable law; or (3) your negligent or intentional misconduct.

(g) Coaching Cancellation

Coaching memberships may be cancelled at any time. Cancellation requests must be submitted at least 48 hours before your renewal date. There are no partial or prorated refunds on coaching fees after the 30-day money-back guarantee period. Coaching programs cannot be paused for any reason.

(h) Force Majeure

CISSP Cyber Training is not liable for failure to perform due to acts of God, war, disaster, fire, civil disorder, pandemics, or other events beyond reasonable control. This Agreement may be terminated without penalty if a force majeure event continues for 30 or more consecutive days.

(i) Online Training Requirements

Online training may require high-speed internet access and audio equipment. CISSP Cyber Training is not responsible for technical issues arising from your equipment or platform connectivity. You may not share, sell, or transfer access links to online training. Violations may result in immediate removal without refund.

9 Community & User-Interactive Areas

(a) Participate at Your Own Risk

You enter and participate in any community, forum, bulletin board, or chat room at your own risk. CISSP Cyber Training does not guarantee to monitor all communications and is not responsible for content posted by third parties.

(b) Prohibited Conduct

You may not: use community areas for illegal purposes; post content that infringes third-party rights; post false, defamatory, threatening, or harassing statements; post obscene or violent content; solicit or advertise commercial products or services; impersonate another person; or post off-topic or disruptive content.

(c) Content Removal and Termination

CISSP Cyber Training reserves the right to remove any content and to remove, expel, or disqualify any user from community areas at any time and for any reason. We also reserve the right to terminate community areas at any time.

(d) Email and Text Communications

If you no longer wish to receive emails or text messages from CISSP Cyber Training, you may unsubscribe at any time using the unsubscribe link in each communication. You are responsible for unsubscribing all email addresses you have registered.

(e) Indemnification

You agree to hold CISSP Cyber Training harmless from any claims arising from your conduct, content, or participation in community areas.

10 Live Events — Waiver & Release

You certify that you are physically and mentally fit to participate and have not been advised otherwise by a qualified medical professional.

You waive, release, and discharge Shon Gerber, CISSP Cyber Training, and their directors, officers, employees, volunteers, and agents from any and all liability for death, disability, personal injury, property damage, or theft occurring in connection with the event.

You consent to receive necessary medical treatment during events. You consent to being photographed or filmed and grant CISSP Cyber Training the right to use such materials for promotional purposes.

Refunds on live event packages are not available after 30 days from purchase. Refunds within 30 days are subject to the standard 30-Day Money-Back Guarantee in Section 3. Any other refunds are subject to a processing fee of up to 10% of the purchase amount.

11 Miscellaneous

(a) Prohibition Against Data Mining

You may not data mine, scrape, crawl, or harvest email addresses from CISSP Cyber Training. You may not use site content to compile a competing listing or product.

(b) Intended Audience

This website is intended for adults only (18+). It is not intended for children under the age of 18.

(c) Compliance with Laws

You agree to comply with all applicable laws in your use of this site and confirm that all information you provide is truthful and accurate.

(d) DMCA Notice

If you believe your copyrighted work has been infringed, contact our Copyright Agent:

Your notice must include: a description of the copyrighted work; location of the infringing material; your contact information; a statement of good-faith belief that the use is unauthorized; and a statement under penalty of perjury that you are the copyright owner or authorized agent.

(e) Member-Submitted Content

Content submitted by members (including images, text, and uploaded files) may be used by CISSP Cyber Training for any business purpose, including promotional activities and testimonials.

(f) Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Kansas. Any legal action must be brought in a federal or state court located in Sedgwick County, Kansas. Both parties consent to such jurisdiction and waive any objection to venue. The prevailing party in any litigation shall be entitled to recover all court costs.

(g) Severability

If any provision of this Agreement is found unenforceable, the remaining provisions continue in full force. Courts may reform overly broad provisions to the narrowest enforceable scope.

(h) Entire Agreement

This Agreement constitutes the entire agreement between you and CISSP Cyber Training regarding your use of this site and its products, superseding all prior agreements. It may not be amended except by written mutual consent.
